Proposed Legislation Would Allow Payment for DSPs During Hospital Stay
As it stands today, states cannot allow payment of Home and Community Based Services (HCBS) while a beneficiary is in the hospital. However, this issue is being addressed by the introduction of legislation in both the US House of Representatives and US Senate to amend the Social Security Act. US Senators Rob Portman of Ohio and Kirsten Gillibrand of New York introduced the bipartisan bill.
The Ensuring Access to Direct Support Professionals Act would authorize states to reimburse DSPs for time spent supporting people who are hospitalized for short-term stays. This not only ensures continuity of care, but it also allows for the individual to be supported by staff that: are familiar to the individual; understand their unique communication, behavioral, and personal care needs; and can serve as an advocate while dealing with the impacts of needing a hospital stay.
